GENERAL:

IMPORTANT – YOUR STAY AT OCEAN REEF RESORT IS SUBJECT TO IMPORTANT LEGAL TERMS AND CONDITIONS THAT AFFECT YOUR LEGAL RIGHTS AND MANDATE DISPUTES BE RESOLVED EXCLUSIVELY BEFORE A COURT IN THE BAHAMAS. READ ALL OF THE FOLLOWING CAREFULLY AS THIS IS A LEGAL CONTRACT

These terms and conditions (as amended November 1, 2019 or supplemented from time to time, these “Terms and Conditions”) state the terms and conditions under which we provide you with various services described on www.oryc.com and our agreement with you regarding your use of this website (our “Site”), the services we provide, and the Ocean Reef Resort, Bahamas Resort (the “Resort”). This agreement is a legally binding contract between you, on the one hand, and Ocean Reef Resort. This agreement governs your use of our Site, and all transportation, accommodations, services and activities included in the trips described on our Site and your use of the Resort.

BY ACCESSING, BROWSING, AND/OR USING OUR SITE AND/OR OUR SERVICES ON THE WEBSITE OR AT THE RESORT, OR RESERVED BY YOU, YOU ARE DEEMED TO ACCEPT THESE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THIS AGREEMENT.

We may make changes to these Terms and Conditions from time to time in our sole discretion. Each time changes are made to these Terms and Conditions, a revised Terms and Conditions will be posted on the home page. Your continued use of our Site and the services on the Site or at the Resort following the posting of changes constitutes your acceptance of any such changes.

These Terms and Conditions apply to all transportation, accommodations, packages, services described on our Site.

OUR PRIVACY POLICY:

The information that we obtain through your use of our Site, whether through the reservation process or otherwise, is subject to the privacy policy posted on our Site (“Privacy Policy”). Our Privacy Policy contains the provisions that govern our collection, use and disclosure of the information you provide to us, including our respective rights relative to that information and are a part of these Terms and Conditions. Please review our Privacy Policy before you use our Site and/or services. If you are unwilling to accept the terms and conditions of our Privacy Policy, please do not use our Site and/or services. Our Privacy Policy may change from time to time in our sole discretion.

VENUE FOR LEGAL CLAIMS & OCEAN REEF REGISTRATION :

During guest registration at the Resort you will be asked to sign a form agreeing to the following terms related to any claims you may have as a result of your stay at the Resort: “I agree that any claim I may have against Ocean Reef Resort  occurring in The Bahamas shall be governed by and construed in accordance with the laws of the Commonwealth of The Bahamas, and further, irrevocably agree to the Supreme Court of The Bahamas as the exclusive venue for any such proceedings whatsoever. The foregoing shall apply to all persons accompanying me, and I represent that I have the authority to sign this document on their behalf.” If you are unwilling to agree to these terms and conditions, prior to signing the form and checking into the Resort you may revise the language by crossing out any words you do not accept. Management reserves the right to review any change you make. You will not be permitted to check in or stay at Ocean Reef Resort  if you revise or delete the terms of the form regarding your promise to pay for your room, damages or other Resort account charges accrued during your stay at Ocean Reef Resort.

BOOKING AND CHECK-IN PROCEDURES:

At least one guest must be at least 18 years of age and present a valid credit card in their name. If under 18, the guest must be traveling with a party where one guest is 18 or older and is the credit card holder for all reservations. Upon check-in at all hotels, you are required to place a credit card on file or pay cash as your security deposit for your incidentals. There is a holding charge on the credit card, which is based on various factors, including number of nights and type of package booked.

HOTEL CHECK-IN / CHECK-OUT

Check-In: 4 p.m.*

Check-Out: 10 a.m.

*Check-in times may vary based on hotels discretion. Additional fees may be charged for early check-in

TAXES, SURCHARGES & RESORT FEE:

Effective July 1, 2018, The Bahamas’ current Value-Added Tax (VAT) rate of 7.5% will increase to 12%, subject to certain limited exceptions as prescribed by the Bahamian Government.

Guests of Ocean Reef Resort are subject to a 15% charge on room rate that includes VAT .

This privacy policy sets out the basis on which any information (which may include personal data) we collect from you, or that you provide to us, through this website will be processed by us. INFORMATION WE MAY COLLECT FROM YOU

When you use the Site or contact us by e-mail, social media, online feedback forms or forms at Ocean Reef Resort, we may collect and process the following data about you:

  • Information you give us, including:
    • Forms filled out by you on the Site or at Ocean Reef Resort, including booking accommodations, requests for proposal for special events, requests for marketing materials, requests to be included in email alerts or texts from us or other inquiries;
    • Content of electric correspondence with us;
    • Site registration and use of your account and features such as “MyPlan”;
    • Participation in media functions on the Site;
    • Entering a competition, promotion or survey;
    • Reporting a problem or requesting support for the Site or your stay with us.

The information you give us may include your name, address, e-mail address and phone number, credit card information, personal description, photographs or images and comments.

  • Information we collect about you.With regard to each of your visits to our Site we may automatically collect the following information:
    • Technical information, including IP address, login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
    • Information about your visit, including the full URL clickstream to, through and from our site (including date and time);
    • Pages you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
  • Information we receive from other sources.
    • We may receive information about you if you use any of the other websites operated by Ocean Reef Resort. In this case we will have informed you when we collected that data that it may be shared internally and combined with data collected on this site. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.

 

HOW YOUR INFORMATION MAY BE USED

We use information held about you in the following ways:

  • Information you give to us. We will use this information:
    • To help us respond to your queries;
    • To carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;
    • To provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about. Where required by applicable law, we will seek your prior written consent before doing so;
    • To provide you, or permit selected third parties to provide you, with sales and marketing information about goods or services we feel may interest you. If you do not want us to use your data for sales and marketing purposes, or to pass your details on to third parties for sales and marketing purposes, please tick the relevant box situated on the form on which we collect your data (the order form or registration form);
    • To notify you about changes to our service;
    • To manage your access to the services;
    • To allow you to interact with our Site;
    • To allow you to share information from our Site on third party social media platforms;
    • To comply with legal and regulatory requirements;
  • Information we collect about you. We will use this information:
    • To administer our site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
    • To improve our site to ensure that content is presented in the most effective manner for you and for your computer;
    • To allow you to participate in interactive features of our service, when you choose to do so;
    • As part of our efforts to keep our site safe and secure;

    • If you sign up to give us access to your social media pages you are consenting to us receiving information collected about you via that social media platform (we will only collect the data you give your consent for us to collect when you sign up for this option).

 

DISCLOSURE OF YOUR INFORMATION

We may share your personal information with our affiliated companies and with selected third parties including:

  • Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you, including fulfilling reservations and offering certain products and services in connection with our Site.
  • Advertisers and advertising networks that require the data to select and serve relevant advertisements to you and others.  We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience.
  • Analytics and search engine providers that assist us in the improvement and optimization of our Site.

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Ocean Reef Resort or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation; or to protect the rights, property, or safety of Ocean Reef Resort, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • To any other third party with your prior consent to do so.

STORAGE AND SECURITY

Your resort stay information is collected and stored by our resort locally.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

COOKIES
Our website may use cookies or other tracking technologies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site.

Children
The Site is not directed toward children under 13 years of age nor does Ocean Reef Resort knowingly collect information from children under 13.  If you are under 13 years of age, you are not permitted to submit any personally identifiable information to Ocean Reef Resort.

YOUR RIGHTS AND CHOICES

We will retain your information for as long as your account is active or as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

If you wish to subscribe to our newsletter(s), email alerts or text alerts, we will use your name and email address to send the newsletter and email alerts to you and we will use your name and telephone number to send the text alerts to you.

Some Browsers support a “Do Not Track” feature, which is intended to be a signal to websites that you do not wish to be tracked across different websites you visit. Certain legal obligations require that we disclose how websites we operate, such as our registration page, react to Do Not Track signals.

Unfortunately there is no common standard among browsers or advertisers on how to implement Do Not Track, and no common understanding of how websites and advertisers should react. Therefore, at this time we do not alter the behavior of the Site for visitors who have Do Not Track signals enabled.

Where provided under applicable law, you may have the right to ask us for a list of your personal data we share with third parties and information regarding those third parties, if the third parties use the personal data for their direct marketing purposes. You can exercise this right at any time by contacting us as described in the “Contact Us” section below.

CHANGES TO OUR PRIVACY POLICY

Any material changes we may make to our privacy policy in the future will be posted on this page prior to the change becoming effective and notify you through the Site or, where appropriate, by e-mail.
